Kathryn Gritzmaker 509th Bomb Wing Legal Office WHITEMAN AIR FORCE BASE, Mo. -- The holiday season is traditionally a time of parties, receptions and exchanging gifts. However, even during the holiday season, DOD standards of conduct still apply. As military members, we must ensure we do not unwittingly violate these standards. As a general rule, supervisors may not accept gifts from subordinates or federal employees who receive less pay than the supervisor. However, there are some exceptions specifically related to holiday parties and gift-giving. Since holidays occur on an occasional basis, supervisors may accept gifts, other than cash, worth $10 or less from a subordinate; additionally, supervisors may accept food and refreshments shared in the office and may share in the expenses of an office party. If a subordinate is invited to a social event at the supervisor's residence, the subordinate may give the supervisor a hospitality gift of the type and value customarily given on such an occasion. There are no legal restrictions on gifts given to peers or subordinates; however, common sense and good taste should apply. Many contractors have rules of ethics or business practices that are similar to the federal rules. These rules should be taken into consideration before offering contractor employees gifts or opportunities that they cannot accept. One important rule regarding exchanging gifts with contractors is that, even during the holidays, gifts may not exceed $20.
