Understanding Confidentiality and Reporting Terms
2. 100% Confidentiality
  1. Defined as 100% Confidential & Privilege
  2. Any communication made to a Chaplain or Religious Affairs Airman by a military member, dependents or other authorized personnel by military necessity that is made either as a formal act of religion or as a matter of conscience. If made to a Chaplain or Religious Affairs Airman in his or her official capacity. May not be disclosed without the consent of the individual. Note that Chapel is the only place that can offer this and they are not mandatory reporters.
3. Limited Confidentiality
  1. Defined as,
  2. Is provided by on-base medical/clinical agencies and it is designed to balance the commander's need to know with the mental well being of members in his/her command with the mental health patient's need for confidentiality and privacy.
4. Restricted Reporting
  1. Defined as, confidential and allows victims of sexual to disclose a crime to specifically identified individuals without triggering the official investigative process or notification to command.
  3. FAP/Mental Health: Allows an adult victim of domestic abuse to disclose the details of abuse to FAP staff, victim advocate or healthcare provider. Under restricted reporting does not allow information to be disclosed to commanders or law enforcement.
  5. SAPR: Disclosure of a sexual assault is kept confidential if made to the SARC, Victim Advocate, medical staff. Person can seek care without triggering an investigation. *INDEPENDENT REPORTING A Person may lose restricted reporting option if they make a disclosure of sexual assault to someone & that person or a bystander reports assault to OSI, security forces or chain of command.
5. Unrestricted Reporting
  1. Defined as, an option for sexual assault victims who desire an official investigation and command notification in addition to healthcare, victim advocacy and legal service.
  3. FAP/Mental Health: Victims of domestic abuse who want to pursue an official investigation should report to chain of command, FAP or law enforcement. FAP clinical services will be offered to the victim upon notification of a reported domestic abuse incident. Details regarding the incident will be limited to only those personnel who have a legitimate need to know.
  5. SAPR: Disclosure to security forces, OSI, first sergeant supervisor, commander or anyone in person’s chain of command triggers an investigation. *INDEPENDENT REPORTING: A Person may lose restricted reporting option if they make a disclosure of sexual assault to someone & that person or a bystander reports assault to OSI, security forces or chain of command.
6. Mandatory Reporting
  1. Defined as, individuals who, when they receive information that a sexual assault has occurred, must report that information.

11. Frequently Asked Questions
1. Who is eligible for SAPR support services?
2. Active duty members, Air Force Reserve and Air National Guard members and their dependents 18 and older who are eligible for treatment in the military health system, and Air Force civilian (appropriated and non-appropriated) employees. SAPR provides support for adult sexual assault victims when the perpetrator is someone other than the victim’s spouse or same sex domestic partner.
4. The Family Advocacy Program manages sexual assault allegations when the alleged offender is the partner in context of a spousal relationship, same sex domestic partnership, unmarried intimate partner relationship or military dependents who are 17 years of age and younger.
6. What do SARCs do?
7. The Sexual Assault Response Coordinator serves as the installation's primary point of contact for integrating and coordinating sexual assault victim care services for eligible recipients. Services may begin at the initial report of sexual assault and continue through disposition and resolution of issues related to the victim's health and well-being. The SARC reports directly to the installation wing commander (or equivalent) or installation vice wing commander, executing the Air Force's Sexual Assault Prevention and Response program at the installation level. SARCs assist unit commanders as necessary to ensure victims of sexual assault receive appropriate and responsive care.
9. Who do I contact for support if I’m deployed to a small forward operating base with no SARC?
10. Contact the SARC located nearest to you. If you’re unsure where the nearest SARC is, visit the DoD Safe Helpline website (https://safehelpline.org/search.cfm) or call 877-995-5247. The nearest SARC will be able to assist you and assign a volunteer victim advocate at your location if one is available.
12. Can my restricted report be made unrestricted by someone else?
13. Your report will remain restricted and confidential. However, if another individual reports your assault to their chain of command or law enforcement, an investigation will be initiated if the case falls under the jurisdiction of the Air Force Office of Special Investigations.
15. Can I report a sexual assault that happened prior to my military service, on TDY or on leave?
16. Yes, your SARC will take your report of sexual assault regardless of when or where the assault occurred. If you choose to make your report unrestricted, the SARC will help notify the appropriate law enforcement officials.
18. Can I report a sexual assault to a SARC from another service or base?
19. Yes, with the exception of Air Force civilian employees. If you are eligible for SAPR support services, then you can file a report with any DoD SARC regardless of location. However, Air Force civilian employees are currently the only Department of Defense civilian employees eligible for SAPR services, and can only receive SAPR services from Air Force SARCs and SAPR victim advocates.
21. How do I know my information will be protected if I make a restricted report?
22. SARCs and SAPR victim advocates are responsible by law and Department of Defense and Air Force Instructions to protect the confidentiality of both restricted and unrestricted reports. SAPR personnel who violate confidentiality rules are subject to the full range of disciplinary action ranging from administrative action to court-martial, depending on the status of the individual in question and the nature of the violation.
24. How to reporting to a SARC, a SAPR victim advocate or a volunteer victim advocate?
25. All three are nationally certified to support victims of sexual assault, can take both restricted and unrestricted reports of sexual assault and have confidentiality under military regulations. All can provide exceptional care and support for victims, SARCs and full time SAPR victim advocates also have additional administrative and managerial duties.

Legal assistance attorneys cannot, however, represent clients in any court or administrative proceedings, nor draft or file legal documents with a court.
